If a physician who had a duty to treat you and did not treat you according to the standard of care, then that physician was negligent. If his negligence caused you harm, you may file a lawsuit for medical malpractice.

Physicians have a duty to conform their medical treatment to the acceptable standard of care of similar physicians in the United States. Even though a physician may claim that his treatment was a "judgment call," that judgment must be within the standard of care.
